New York's fast food restaurants can now ignore a city law requiring fast food establishments to post calories counts on menu boards in restaurants as it has been overturned.
U.S. District Judge Richard Holwell ruled that the city had the power to require nutritional labeling, but the regulation at issue was pre-empted by a 1990 federal law that established nutritional labeling in the first place, which sets out guidelines for voluntary presentations of nutritional information, such as on tray papers or on Web sites.
Interesting turn of events and bravo to all those establishments that immediately complied. Personally, I was all for the calorie posting law. Sure in 1990, it was not mandatory, but was 30% of the country obese then?

Thank the Lord. Now companies like Blimpie and Cold Stone can finally POST their nutritional content again on their sites and not withhold it from all of us in America just so that they don't have to re-do their menu boards in new york. NYC obviously didn't think through the adverse effects of this law.
1That is so cool... If only Oregon had this law.
2I don't mind if the nutritional data is listed on the menu or on a separate list. I just like to know what the calorie counts are so I can make a healthy choice.
3I think if someone cares enough they will look up the information before hand. If you care that much about your calorie in take then you should be eating less fast food anyways. If you have a healthy life style a little Burger King or *GASP* Dairy Queen ice cream (OMG!) isn't a big deal every now and then. I wouldn't want to stand in like for 30 minuets or wait in the drive through line forever because people who don't feel like exercising can compare all the calories for everything, if you do exercise on a regular basis then you should stop being so damn obsessive about the calories in stuff anyways. Just enjoy the treat. The whole thing is just ridiculous, I'm not shocked they threw it out.
4It's not just fast food. Prior to a dinner party or lunch date I like to go online and look at the menu/nutritional info so I can plan my meal. It's not because I don't have a healthy lifestyle! Just the opposite! I don't think I should stay home or just have a dry salad because I choose not to eat fried, breaded or smothered food. I love Chili's & Applebee's for having healthy menus I can check out online!
5i dont really care if its posted on the menu board, as long i have access to it i am a-ok with it (online or restaurant postings)
6I think its important to have the calories with the food as a reminder to what you are actually putting into your body.
7I am all for getting more information about nutritional content in restaurants. Here on FitSugar we are many readres conscious about healthy living and know a lot about nutrition, calories etc... but I believe many people are unable to understand nutritional info so maybe a system with smileys or something in addition would make it easier for everybody to understand what is a healthy choice and what is not...
8probably in the first few weeks, people will notice and be aware of the cals.. after a while.. people got bored and MAYBE they'll all go.. "what the heck" and start ordering their faves haha
9We need that in Canada!
10I pretty much look up the information before I go out to eat. Although, I don't think it is necessary to post on the big overhead menu, it would be nice if the information were readily available, should someone like to see it.
11Finally a great idea. I wish every place you eat at had this.
12how disappointing. this law was great. people eat fast food. it's unhealthy and they shouldn't but they do. they know it's unhealthy, but i would bet that they have no idea how many calories are in the food. people underestimate their caloric intake by 100s of calories. and those quickly add up to a pounds worth of calories over time.
apparently the current system isn't working. fast food isn't going anywhere. people are still eating it. we need to try something new. and i really think this law could have been that something new.
